タクシーサイト利用規約

この度は、TAXISITE（以下「本サイト」といいます）へお越しいただき誠にありがとうございます。
TAXISITEは、下記の「タクシーサイト利用規約」に従ってサービスをご利用いただきます。利用者の皆様は、本サイトを利用することで下記の規約に同意いただいたものとみなしますので、内容をご確認の上ご利用ください。

第1条（本規約の適用範囲）

  1. 本タクシーサイト利用規約（以下「本規約」といいます）は、株式会社タクシーサイト（以下「当社」といいます）が運営するウェブサイト「TAXISITE」および、TAXISITE内で提供される「Ride Plus」を含む各種サービス（以下総称して「本サービス」といいます）の利用に関して適用されます。
  2. 本サービスを利用する方（以下「利用者」といいます）は、本規約を承諾した上で本サービスを利用するものとします。
  3. 「Ride Plus」は、タクシー会社（以下「タクシー事業者」といいます）が貸切プラン等を事前に登録し、利用者がインターネット上から予約・決済を行うサービス機能を指します。

第2条（規約の改定）

  1. 当社は、法令の変更やサービス内容の変更に対応するため、合理的な範囲で本規約を改定することがあります。
  2. 改定内容が利用者の権利義務に重大な影響を与える場合は、当社は事前に当社ウェブサイト上への掲載、または利用者への電子メール等の方法により周知し、必要に応じて利用者からの同意を得るものとします。
  3. 改定後の本規約は、当社が定める発効日から効力を生じるものとし、利用者が本サービスを継続して利用した場合、改定後の規約に同意したものとみなします。

第3条（利用に際しての注意事項）

  1. 利用者は、本サービスを利用するために必要な通信機器、ソフトウェア、インターネット接続環境等を自己の費用と責任において用意し、適切に運用するものとします。
  2. 当社は、利用者がインターネットに接続するための手段や方法、設定、操作等に関して一切関与せず、その責任を負いません。
  3. 本サイトを通じて提供される各種情報（タクシー事業者情報、運賃情報、観光情報、求人情報、観光コース情報、スポット情報等）や、Ride Plusを通じた予約により利用したタクシー事業者のサービス内容については、利用者の自己責任で判断・利用するものとし、当社はその正確性・有用性、目的適合性等を保証するものではありません。

第4条（禁止事項）

利用者は、本サービスの利用にあたり、以下の行為またはそのおそれがある行為を行ってはならないものとします。

  1. 本サービス内の情報を不正に改ざん、消去、複製、または改変する行為
  2. 他の利用者や第三者、または当社の権利・利益・名誉等を侵害する行為
  3. 他の利用者や第三者、または当社を誹謗中傷し、不利益や損害を与える行為
  4. コンピュータウイルスやその他有害なプログラムを使用、もしくはそれらを提供、推奨する行為
  5. 法令または公序良俗に反する行為
  6. 本サービスに関するシステムやサーバー、ネットワークに対する不正アクセス行為
  7. Ride Plusにおける予約機能や問い合わせ機能を悪用して、正当な理由なくキャンセルを繰り返す等、タクシー事業者や第三者に不利益を与える行為
  8. その他、当社が不適切と判断する行為

第5条（免責事項）

  1. 当社は、Ride Plusを通じたタクシー事業者と利用者との間の予約・決済の成立を除き、本サービスの提供内容ならびに本サービスを通じて得られる情報（タクシー会社情報、運賃、観光情報、求人情報、観光コース、質問回答等）の正確性、最新性、有用性等について、いかなる保証も行いません。また、利用者は、Ride Plusを通じてタクシー事業者と利用者との間に予約・決済が成立した場合といえども、タクシー事業者が自己の都合によりキャンセルする場合があること、かかる場合も当社は一切の責任を負わないことにつき、あらかじめ了承するものとします。
  2. 当社は、当社の故意または重大な過失による場合を除き、本サービスの利用または利用不能により利用者または第三者に発生した損害について一切責任を負いません。
  3. 天災や当社に故意又は重大な過失がないシステム障害、通信回線の不具合その他やむを得ない事由により本サービスが中断・停止し、利用者に損害が発生した場合でも、当社はその責任を一切負いません。
  4. Ride Plusを通じて成立するタクシー事業者と利用者との間の契約内容やトラブルについては、当事者間で解決するものとし、当社はこれらに関して責任を負いません。

第6条（決済および手配に関する責任分担）

  1. Ride Plusにおいてタクシーの貸切プラン等を予約する際の決済は、当社が指定する決済代行会社によって行われます。利用者がクレジットカード等を用いて決済を行う場合、当該クレジットカード情報は決済代行会社が直接取得・管理し、当社は一切保持しません。
  2. 決済代行会社のシステムトラブル、利用者のクレジットカード不正使用等の事由により利用者に損害が発生した場合、当社に故意または重大な過失がない限り、当社は責任を負いません。
  3. 利用者が支払う代金の明細には「Ride plus」等と表示される場合がありますが、これは当社がタクシー事業者への支払いを代行しているためであり、実際の運送サービス提供者はタクシー事業者です。
  4. 当社は、決済代行会社から不正利用の疑いがあることを理由に、決済代行会社から利用者情報の提供を求められた場合、これに応じることができるものとし、利用者は予めこれに同意するものとします。

第7条（キャンセル・返金）

  1. 利用者が、Ride Plusにおけるタクシーの貸切プラン等を予約した後にキャンセルを希望する場合は、各タクシー事業者が独自に定めるキャンセルポリシーに従うものとします。
  2. 返金が発生する場合、その金額・タイミングは決済方法やクレジットカード会社等の処理状況によって異なります。原則当社は返金処理に関するお問い合わせに対して、必要に応じて確認を行う場合がありますが、返金処理自体に関して一切の責任を負いません。利用者は、当社が指示したご利用のクレジットカード会社やタクシー事業者に直接確認するものとします。
  3. キャンセル料・違約金の有無やその金額については各タクシー事業者が独自に定める規約に従うため、利用者は事前に必ず内容をご確認ください。

第8条（サービスの変更・中断・終了）

  1. 当社は、以下のいずれかに該当する場合、利用者への事前の通知なく本サービスの全部または一部を変更・中断・終了することができます。
    1. サービス用設備やシステムの保守・点検を行う場合
    2. 停電、通信障害、天災、火災、その他の不可抗力により本サービスの提供が困難な場合
    3. 法令の定めまたは行政機関の命令等により本サービスの提供が困難な場合
    4. その他やむを得ない事由がある場合
  2. 前項の場合、当社は可能な範囲で速やかに事後の通知を行いますが、利用者または第三者が被った損害について、当社は一切責任を負いません。

第9条（権利帰属）

  1. 本サービス（本サイト上に掲載される文章、画像、デザイン、プログラムを含む）に関する著作権、商標権その他一切の知的財産権は当社または正当な権利を有する第三者に帰属します。
  2. 利用者は、当社または第三者の権利を侵害する態様で、本サービスに含まれる情報等を無断で利用・転用してはなりません。

第10条（準拠法および合意管轄）

  1. 本規約の成立、有効性、履行および解釈に関しては日本法が適用されるものとします。
  2. 本規約または本サービスに関連して当社と利用者の間で生じる一切の紛争については、その訴額に応じ、東京地方裁判所または東京簡易裁判所をもって第一審の専属的合意管轄裁判所とします。

プライバシーポリシー

株式会社タクシーサイト（以下「当社」といいます）は、当社が運営するウェブサイト「TAXISITE」（以下「本サイト」といいます）および、本サイト内で提供する「Ride Plus」や「taxisite plus」などのインターネット予約・手配サービス（以下「手配サービス」といいます）を含む各種サービス（以下、総称して「本サービス」といいます）において取得・利用する個人情報について、以下のとおりプライバシーポリシー（以下「本ポリシー」といいます）を定め、利用者の個人情報の保護に努めます。

本ポリシーは、当社が別途定める「利用規約」とともに、本サービスを利用するすべての方に適用されます。

第1条（基本的な考え方）

  1. 当社は、個人情報保護法および関連する法令・ガイドラインを遵守し、利用者から取得する個人情報を適切かつ安全に取り扱うため、社内規程を整備するとともに、全従業員に対する教育や安全管理措置を講じています。
  2. 当社は、本ポリシーを通じて、利用者が安心して本サービスをご利用いただけるよう、個人情報の取扱いに関する基本的な方針を開示いたします。

第2条（取得する個人情報）

当社は、本サービスの提供にあたり、以下の情報を必要に応じて取得する場合があります。

  1. 利用者から直接提供される情報
    • 氏名、住所、電話番号、メールアドレスなどの連絡先情報
    • 生年月日や性別などの属性情報（任意）
    • お問い合わせや各種フォーム送信時に入力される情報
    • 手配サービスでのタクシー予約に必要な利用日時・目的地・人数などの旅行（移動）に関する情報
    • その他、利用者が本サービス利用時に自発的に提供する情報
  2. サービス利用に関連して取得される情報
    • タクシー会社への問い合わせ内容・履歴
    • タクシー会社が登録した観光コースへの問い合わせ履歴
    • 本サイト内で行った検索内容、観光スポット情報投稿内容、業界用語辞典の投稿内容、サポートへの質問・要望等
  3. 自動的に取得される情報（アクセス情報等）
    • IPアドレス、ブラウザの種類・バージョン、OS情報、閲覧日時、閲覧ページURL などのアクセスログ
    • スマートフォン等で位置情報の取得を許可いただいた場合の位置情報
    • クッキー（Cookie）等を利用して取得するアクセス情報
    • 手配サービスにおける予約状況や操作ログ
  4. 決済関連の情報
    • クレジットカード情報は決済代行会社により直接取得・管理され、当社はカード番号等を保持しません。
    • 不正利用が疑われる場合、決済代行会社から不正調査に必要な情報（受付ID、申込者名・連絡先など）を照会されることがあります。

第3条（クッキー（Cookie）の利用および解析ツール）

  1. 当社は、利用者の利便性向上やアクセス状況の統計的な把握のために、クッキーを使用することがあります。
  2. 利用者はブラウザの設定により、クッキーの受け取りを拒否したり、クッキーが送信される際に警告を表示させることができます。ただし、その場合、本サイトの一部機能がご利用いただけない場合があります。
  3. 当社は、アクセス解析のためにGoogleアナリティクス等の解析ツールを利用する場合があります。これらツールではクッキーを使用して本サイトの利用状況を分析し、レポート化しますが、当該ツールにより個人を特定できる情報は取得されません。

第4条（個人情報の利用目的）

当社が取得した個人情報は、以下の目的に利用いたします。

  1. 本サービスの提供および運営
    • タクシー会社検索や運賃検索、求人情報、観光情報等、本サービスの各種機能を提供するため
    • 手配サービスにおける予約手続、タクシー会社との連絡・調整
  2. 本サービスの利便性向上や品質改善
    • アクセス解析や利用状況の統計分析によるサービス改善
    • 新機能、新キャンペーン等の開発・検討
  3. 必要な連絡や通知
    • システムメンテナンスや規約変更、本サービスに関する重要なお知らせの送付
    • 質問や問い合わせへの回答
  4. 不正利用・トラブル等の防止
    • 利用規約違反の調査、本人確認、不正アクセスの監視
    • 不正なクレジットカード利用やチャージバックへの対応
  5. 法令等の要請への対応
    • 法令、条例、行政機関、裁判所等の要請に基づき必要な範囲で開示・提供する場合

第5条（第三者提供）

  1. 当社は、あらかじめ利用者の同意がある場合、または個人情報保護法その他の法令に定めがある場合を除き、個人データを第三者に開示または提供しません。ただし、以下のいずれかに該当する個人データの第三者提供については、利用者が「利用規約」及び本プライバシーポリシーへの同意することにより、あらかじめ提供に同意したものとみなします。
    • 利用者が手配サービスでタクシー会社（事業者）のプランを予約・問い合わせする際、必要な範囲で当該タクシー会社に利用者の情報（名前、連絡先、予約内容等）を提供する場合
    • 決済代行会社との間で、決済や不正利用調査に必要な情報を照会・提供する場合
    • 統計的なデータなど個人を特定できない形式に加工した情報を開示・提供する場合
    • 当社および当社グループ会社のサービスのご案内及びサービス品質の向上等の目的で当社グループ会社に提供する場合

第6条（個人情報の管理・安全措置）

  1. 当社は、取り扱う個人データが外部に漏えいしないよう、適切な技術的措置および組織的措置を講じます
  2. 当社は、個人データを正確かつ最新の内容に保つよう努めるとともに、不正アクセス・改ざん・漏えい・滅失・き損等の防止に努めます。
  3. 当社は、従業員や業務委託先（システム開発会社等）に個人データを取り扱わせる場合、十分な監督を行い、秘密保持契約の締結など必要な措置を行います。

第7条（保有個人データの開示、訂正、利用停止等）

  1. 利用者は、当社の保有する保有個人データについて、個人情報保護法の定めに基づき、開示、訂正、追加、削除、利用停止、第三者提供の停止、または利用目的の通知を求めることができます。
  2. 前項の請求及び当社の第三者提供記録の開示請求を希望する場合は、第11条（お問い合わせ窓口） に記載の連絡先へご連絡ください。請求内容に応じて、当社所定の手続き（本人確認等）を経た上で対応いたします。
  3. 保有個人データの開示・訂正等の手続を行う場合、法令により認められた手数料を請求する場合があります。なお、手数料の詳細はご請求受付時にご案内します。

第8条（EU圏／EEA（欧州経済領域）に所在する利用者の方へ）

  1. 当社は、EU一般データ保護規則（GDPR）を含む関連法令を遵守します。EU/EEA内に所在する利用者の皆様に関しては、本ポリシーに加え、GDPRが適用される場合があります。
  2. 利用者は、GDPRが認める範囲で、データアクセス権（開示請求）、データの訂正・削除を要求する権利、処理の制限やデータポータビリティを求める権利等を行使することができます。
  3. 詳しくは 第11条（お問い合わせ窓口） にご連絡ください。必要に応じて、適切かつ誠実に対応いたします。

第9条（免責）

  1. 利用者本人が自ら第三者に個人情報を開示した場合、または利用者が本サイトや手配サービス以外の手段を通じてタクシー会社等に直接提供した個人情報について、当社は一切の責任を負いません。
  2. 当社は、本ポリシーに基づく適切な安全管理措置を講じたにもかかわらず、不可抗力や第三者の不正行為等によって利用者の個人データが漏えいした場合、法令上免責が認められる範囲で責任を負わないものとします。

第10条（プライバシーポリシーの改定）

  1. 当社は、本ポリシーを必要に応じて改定することがあります。
  2. 改定内容を行う場合、重要な変更については当社ウェブサイト上での公表または利用者へのメール連絡等の方法によりお知らせし、必要に応じて利用者の同意を得ます。
  3. 改定後の本ポリシーは、当社ウェブサイト上に掲載した時点、または別途定める発効日時から効力を生じるものとします。

taxisite Inc., (hereafter, “the Company”) complies with the Personal Information Protection Law and other related laws, regulations, and guidelines and takes stringent care as described below with regards to customer personal information used by the Company in the provision of services. Furthermore, although policies pertaining to each service provided by the Company are based upon the provisions of this policy, said agreements for each service shall take precedence if and when the provisions specified therein differ from this privacy policy.

1. Basic Objectives

The Company collects data from all those who use TAXISITE within the scope required for the smooth operation of the service provided on TAXISITE. Collected data will be used appropriately within the scope given by objectives for its use.

2. Collection of Personal Information

(1) Information provided by the customer

  • Name, postal code, address, phone number, date of birth, sex, email address, etc.

(2) Data acquired in connection with use of the service

  • Information related to subscriptions to email newsletters etc. sent by the Company.
  • Information concerning statements or the contents of records made when the customer: asks questions of the Company or a taxi operator; participates in surveys or promotions; uses an electronic bulletin board; evaluates the service(s); or otherwise communicates via telephone, electronic mail, or other means.

(3) Information acquired automatically at the time of access

  • Information concerning the IP address used when the customer’s computer connects to the internet and information that identifies the type of device used.
  • Information acquired at the time the customer accesses the website operated by the Company, such as the type of browser used and its version, the operating system, the platform, and other such information as well as the pages (URLs) accessed by the customer, the date and time these are viewed, the products displayed or searched for, and other such information.

In addition to the above, information that is automatically collected and stored each time the customer uses TAXISITE services, such as access information acquired via such means as cookies.

3. Purposes for Use

The Company will use customer personal information it has acquired for the purposes given below (hereafter, “Purposes for Use”).

(1) When the customer uses the Company’s service(s)

  • For the automatic display of member information for the purpose of increasing the convenience of TAXISITE during the provision of services or operation of systems.
  • To give notice to the customer about official announcements, site maintenance, or important notifications.
  • For delivery of advertisements.
  • For procedures to contact customers during the course of travel sales services, to arrange travel services provided, and to issue receipts for services.

(2) Execution of transactions provided by the Company

  • For procedures involved in the provision of services or the shipping of products that have been purchased from the Company.

(3) Responding to inquiries from customers

  • To respond to inquiries sent to the Company by the customer via email, mail, phone, or other means.

(4) Understanding usage conditions

  • In addition, the Company will correct or revise a customer’s personal information or discontinue its use if a request to do so is received from the customer and upon confirmation of the requestor’s identity. However, this provision will not apply for the correction, revision, or discontinuance of use of information such as that acquired automatically and for which identification of the individual to which it is associated is difficult.

4. Understanding of Site Usage Conditions

TAXISITE uses Google Universal Analytics to understand the status of usage of the site. Universal Analytics collects customer information using cookies. The access information collected helps the Company understand usage status statistically and accumulate knowledge over time in order to improve the usability of TAXISITE. Please see below for Google’s Privacy Policy and for the method by which you may disable Universal Analytics.

5. Delivery of Advertisements

When advertisements distributed by third parties are displayed on TAXISITE, said third parties acquire and use the cookie information of customers who have visited TAXISITE in order to display appropriate advertisements. Cookie information acquired by said third parties is handled in accordance with said third parties’ privacy policies. Customers may discontinue the use of cookie information for the distribution of advertisements by said third parties by accessing the Opt-Out pages (where cookie functionality may be disabled) provided on third party websites.

* A “cookie” is a mechanism by which information generated when a customer views a website is stored on the customer’s computer as a file. TAXISITE uses cookies primarily for the improvement of the site and to automatically display member information.
Customers may disable cookie functionality in their browser settings; however, please be aware that rejecting all cookies may prevent you from logging into user accounts and may limit your ability to use various services on the internet.

6. Limitations to Use and Availability

The Company will not itself use or provide to any third party any collected information for purposes other than the Purposes of Use given above unless it has received a lawful request for disclosure; unlawful behavior has occurred such as unauthorized access or the making of threats; or other specific reasons require it. However, the Company may make public access information or user attribute information for TAXISITE that has been statistically processed.

7. Security Measures

The Company implements measures required for the appropriate management of information collected, such as measures for the prevention of leakage, destruction, or alteration of information.

8. Verification of Personal Information

If the Company receives a request from a customer for the disclosure, correction, discontinuance of use, or deletion of their own personal information, the Company shall fulfill this request upon confirmation of the customer’s identity. Please submit requests via the contact information given below. Additionally, please note that the Company may be unable to accept requests for verification etc. for reasons specified in the Personal Information Protection Law.
Please purchase a postal money order for ¥300 as a handling fee and enclose it together with documents corresponding to the items given below. These may be submitted to our customer service address. (Please note that we are unable to accept payments on delivery. We apologize for any inconvenience.)

  • Copy of certificate of residence
  • Certificate of entries to resident registration (original)

9. Disclaimer

The Company is not involved in the management of customer IDs or passwords. Unless you take due care, your ID and password may be used by a third party to view the personal information you have registered in your account. We ask that you handle your usage of our services and your account responsibly and take precautions to avoid misuse or unauthorized use by a third party.

株式会社タクシーサイト（以下「弊社」という）は、EU一般データ保護規則（GDPR）その他の関連法令等を遵守し、弊社が業務上使用する欧州経済領域（以下「EEA」という）内に所在するお客様の個人データについて、以下のようにその保護に厳重な注意を払ってまいります。GDPRプライバシーポリシー（以下「本プライバシーポリシー」という）は、プライバシーポリシーの規定に加えて適用されます。尚、プライバシーポリシーで規定する内容に本プライバシーポリシーで規定する内容が抵触する場合には、本プライバシーポリシーの規定が優先するものとします。

本プライバシーポリシーは、弊社サービスを利用するEEA内所在者のうち、GDPRその他の関連法の適用のあるお客様に対して適用されます。

２．データ処理の目的と法的根拠

（１）お客様が当事者である契約の実行、またはお客様の要請により契約締結前に手続きを行うため（旅行販売事業におけるお客様への連絡、提供する旅行サービスの手配、サービス受領のための手続き等）

（３）お客様または他の個人の重大な利益を保護するため（事故の際に警察や病院にお客様または他の個人のデータを提供する等）

３．個人データの保存

GDPR Privacy Policy (for customers located in the European Economic Area)

Taxisite Inc. (hereon referred to as "our company") will abide by the EU General Data Protection Regulations (GDPR) and related laws, and will strictly abide by the following measures to protect personal data collected from customers located in the European Economic Area (hereon referred to as the "EEA") for its business activities. The GDPR Privacy Policy (hereon referred to as "this Privacy Policy") applies in addition to the stipulations of the Privacy Policy. Furthermore, when content of the Privacy Policy is found to infringe upon the content of this Privacy Policy, the stipulations of this Privacy Policy will take precedence.

1. Scope of this Privacy Policy

This Privacy Policy applies to customers using our company's services, located within the EEA to whom the GDPR and related laws apply.

Customers younger than 16 years old require the consent of a guardian when using our company's services.

Our company's website may include third party information in links, banners etc. When accessing third party sites, please refer to the privacy policies of each site.

2. Purpose of data collection and legal basis

(Contacting customers, arranging travel services which we offer, arrangements in preparation for receiving services etc., as part of our travel business operation.)

(3) When to do so would protect the vital interests of a customer or another individual. (In the event of an accident, providing a customer or another individual's personal data to police or a hospital etc.)

(4) When necessary to protect our company's legitimate interests. (Collecting usage statistics to improve upon standard business operations such as correspondence with customers, our website etc.)

Please note that a customer may not be able to use our company's services if they do not provide personal data.

3. Storage of personal data

Our company will not store more personal data than is required for collection purposes. When personal data is no longer required in light of the purpose for which it was collected or processed, our company will delete the data.

4. Transfer of personal data

Our company may transfer personal data to third parties such as transport authorities or accommodation (includes overseas premises) when it is required to execute contracts to which a customer is party, or, at the request of a customer, to carry out tasks in advance of a contract. When transferring data to countries which have not received an adequacy decision from the European Commission, our company will transfer customers' personal data in the appropriate fashion.

5. Rights of customers located in the EEA

Customers located in the EEA who use our company's services have the following rights.

Withdrawal from agreement : regarding any agreement to process personal data, a customer has the right to withdraw from the agreement at any time.

Access : a customer may receive a copy of their own personal data held by our company.

Amendment : a customer may request amendment of any inaccuracies in their own personal data.

Deletion : a customer may delete any of their own personal data held by our company, processed for purposes outside the legitimate interests of our company.

Data portability : a customer may transfer any of their own personal data held by our company to a third party which has been automatically processed based on an agreement or contract.

Objection : a customer may voice objection to any of their own personal data being processed in line with our company's legitimate interests.

In addition to the above rights, customers have the right to file a complaint with a regulatory authority.
